Are you up to speed on the legal requirements of providing guests with WiFi? If not, read on...

Following recent changes in legislation including the Digital Economy Bill, providers of WiFi for public use are now required to keep a record of such usage and retain that information for at least 12 months.

This could be potentially onerous and fraught with issues! Too much information could find you in conflict with the Data Protection Act and infringing privacy laws. Too little and you may not comply with the latest requirements.

Based on our understanding of the legislation we advise all WiFi providers to ensure that:

  • Access to WiFi is password controlled and that guests are allocated a unique password to access this service.
  • Passwords should be changed regularly (and not be your own password)
  • This information should be recorded alongside the guest's name and dates of their stay.
  • You should ensure that your WiFi system has necessary controls to prevent illegal downloading and file sharing. We recommend that you discuss this with your WiFi provider.
